Highway Tripping Claims

If you or a person you know has suffered a private injury as a result of a damaged pavement or pot hole in the path or road, then you need to seek legal help as you could be entitled to claim compensation for the injuries you have sustained.

One of the most typical causes of tripping claims is either due to raised paving slabs or cobblestones in the city centres, housing estates, college or maybe in local parks maintained by the local council or authority.

If you have been unfortunate and this has happened to you and you wish to pursue a claim for personal injury you must take clear footage demonstrating the measurement of the depth or height of the defect.

For the defect to be assumed unsafe the depth or peak of the defect must be at least an inch, if you do not have a ruler to hand then a 50 p piece is about an in. so place this next to the defect and take a photograph and date the photograph on the back.

It would also be beneficial if you could build whether there had been any other similar accidents in the area and how long the area had been in a bad state of decay prior to your accident.

Pursing a claim for personal injury following a fall against the local council can be quite hard and so you will need as much evidence as feasible to prove their laxity so if you can provide details of any witnesses to the event this is going to help and support your statement of events.

To substantiate any injury you sustain you must have medical evidence to support any injury claim you may wish to make So please seek medical advice as fast as possible after the situation and counsel them as to how and where you sustained the injury.

To achieve success in a claim against the local council or roads agency your representative must be able to prove they were culpable for failing to maintain or fix the public path and/or road, and so will request sight of their upkeep records.
